An experienced chemist and patent attorney who defends his client’s cases with passion and creativity
With over 25 years of experience as a patent professional, Klemens’ practice focuses on the life sciences (new drugs, therapies and formulations) and other areas of chemistry such as polymers, paper chemistry, fluorochemicals, printing technologies and functional materials for displays and solar cells. He is frequently involved in EPO opposition and appeal proceedings and enjoys manoeuvring his clients through the complex legal and procedural challenges of these proceedings. To this end, he is always determined to get to the heart of the issue to achieve the best possible result for each and every case.
Klemens has specialised in the area of patent extensions (SPCs) and paediatric SPC extensions. He has filed and coordinated several hundreds of SPC applications throughout Europe and has been involved in numerous court proceedings relating to SPCs. He takes great pleasure in developing suitable SPC filing strategies together with his clients in this complex and quickly changing legal field. Klemens is also the author of several publications on SPC matters and frequently holds lectures on this topic.
Prior to joining HOFFMANN EITLE in 1994, Klemens completed his doctoral thesis at the technical University (TH) of Karlsruhe on biosynthesis reactions in plants (1992). From 1992 to 1994, he worked as postdoctoral fellow at the University of Hawaii on the isolation and structural elucidation of anti-cancer drugs from marine plants. This research was supported by Scholarships from the State Graduate Sponsorship Program as well as the German Research Association (DFG) and led to several publications.
Otherwise Klemens enjoys spending as much time as possible with his family. His hobbies include playing the piano, going mountain biking and hiking.
Examination, opposition and appeal proceedings before the German and European Patent Offices and the Federal Patent Court in chemical and pharmaceutical patents; litigation and legal opinions; numerous proceedings in Supplementary Protection Certificate matters. Particular expertise in paper chemistry, photochemistry, organic chemistry, especially in the pharmaceutical and agrochemical fields, and nanomaterials.
