Summary on the Latest Amendments to the German Trademark Act

Angela Wenninger-Lenz and Felicitas Richter, both German attorneys at law and members of the Soft IP group at HOFFMANN EITLE, have compiled a summary of the latest amendments to the German Trademark Act as enacted by the Trademark Law Modernization Act that entered into force January 14, 2019.

Their summary includes not only information on a new prerequisite for protection, i.e. determinability, but also on the new absolute grounds for refusal and the introduction of national warranty marks. It also includes information on inter alia the new proceedings regarding cancellations of trademarks at the GPTO, the new option of registering licenses and presumption of urgency as now included in the German Trademark Act.
