Introducing: HOFFMANN EITLE QUARTERLY

News | 17.06.2021

HOFFMANN EITLE QUARTERLY will be published – as the name suggests – four times a year and will cover new case law and legislation, recent legal developments and points of practice. This first issue includes a colorful mix of current topics in intellectual property in Europe. We begin with an article which concerns the important and ever-evolving question of formal entitlement to priority at the European Patent Office (EPO). The next article addresses the very current activity of changes to the German Patent Act. We then offer insight into the "Paper Dispenser" decision of the German Federal Court of Justice on the protectability of a product both as a design and as a patent, and EPO Enlarged Board of Appeal decision G 1/19 on computer-implemented simulations. The recent developments concerning oral proceedings by videoconference at the EPO are also discussed. Finally, a brief, and possibly very relevant update is provided concerning new requirements regarding extraterritorial taxation of licensing revenue.
