The HAAR in the Soup

Dr. Thorsten Bausch, German and European Patent Attorney and member of HOFFMANN EITLE's chemistry team, has recently commented on an interesting referral to the Enlarged Board of Appeal. The question referred was raised in decision T 0831/17 and concerns, inter alia, the appropriate venue of oral proceedings before the Boards of Appeal. A few years ago, the Boards of Appeal were requested to move to Haar, a small town near Munich, but not part of the City of Munich. The referral may touch on the question whether the relocation of the Boards of Appeal to outside Munich’s city limits was in accordance with the EPC.
